The State Crime Lab has matched bullets used in the November shooting of two men in a wooded area near Stone Mountain Road to a Mauser rifle found on the property, the Faulkner County Sheriff's Office has confirmed.
At the time of the shooting, Alan Grubb, 52, was living on the property at 280 Stone Mountain Road then owned by acquaintance Terrilyn Marteney.
On Nov. 19, brothers Gary and Tommy Phillips, 25 and 21 years old at the time, respectively, were riding in a truck driven by another man through the woods behind the home when one was shot in the thigh, the other in the forearm.
"It looks like what it amounts to is that this guy (Grubb) heard some people on the back side of his property and just started shooting," Maj. Andy Shock of the Faulkner County Sheriff's Office said in November. "There were five or six bullet holes in the truck."
Investigators combed the property after the shooting, finding several shell casings consistent with a high-powered Mauser rifle and other firearms, but not the Mauser itself. Marteney told investigators that Grubb had owned such a rifle, but had sold it prior to moving to Faulkner County.
Gubb agreed to come in for questioning on the day of the shooting and was subsequently arrested. Even without the rifle, prosecutors felt evidence was sufficient to charge Grubb with three counts of first-degree battery and one count felon in possession of a firearm in the days after his arrest.
He has remained in custody since the shooting on a $50,000 bond. His jury trial is set for July 22.
The rifle was discovered after Marteney sold the property. It was found earlier this year in bushes behind the home by the new owner, who reported the discovery to investigators, Sgt. David Hall of FCSO said Friday.
