Prosecutor requests ASP investigation into candidate's resignation

20th Judicial Prosecuting Attorney Cody Hiland said Monday he has submitted a letter to the Arkansas State Police requesting an investigation into the circumstances surrounding the Oct. 3 resignation of Faulkner County Justice of the Peace Mark Bailey.

“The investigation will serve to gather the facts surrounding the circumstances and the documentation of Mr. Bailey's address,” Hiland said. “In a case like this, intent is everything.”

Bailey, a Republican, was seeking re-election to his District 8 position on the Quorum Court but resigned just weeks before the General Election amid questions surrounding the legitimacy of an address he claimed on his filing papers. He has served on the quorum court for 10 years.

Bailey listed 701 Reedy Road #5 in Conway as his address, which is in River Drive Mobile Home Park. The address listed, however, is a vacant, structureless lot.

Hiland said there has been no request to investigate the residency of Conway mayoral candidate Mark Elsinger, who sources alleged last week does not live inside of Conway city limits.

Faulkner County Election commissioners say there is nothing they can do with the ballot concerning those who file for office if it is found out they do not reside where they filed and the circuit court is the ultimate authority over a candidate's removal from the ballot.

Hes a Republican lets see if they get him , he knows where he lived and what address he put when he filed. And he should pay back the money he was paid for not living in the right zone. His vote should not even count when he wasent living where he said.

Highland says

In a case like this intent is everything. However you still have not charged the Chief of Mayflower. Don't give us voters the song and dance that you are waiting on standards and if you don't like the outcome you will go after him. This JP withdrew yet your wanting an investigation so you can go after him because of his intent. What about the Chief of Mayflowers intent. He sent in fraudulent papers but you want to see the outcome. You pick and choose Mr. Highland it's not about justice.

Yeah, he's a real stand-up guy. He only withdrew because he got caught when someone else noticed it. How long had he been fraudulently "serving" know full well he was ineligible?

Who's Investigating Hiland?

Maybe if Mr. Hiland had ever tried a case or had any experience in criminal prosecution before being elected the prosecutor he wouldn't use the office as if he was still a politico. The front page of this paper cites two murders of Conway citizens, is going after this low level politician really the best use of taxpayer funds and the prosecutor's office? Lying about an address to get on a ballot is hardly something Mr. Hiland should be personally involved in unless it is as it appears....personal.

Am I missing something? I only see one and that is in reference to the owner of the Conway Roller Rink. Please explain to me how a PA is supposed to prosecute someone who committed a murder when there does not appear to be a suspect at this time? Detectives investigate a crime and THEN they pass on their findings to the PA.
