Accident at Mapco September 19, 2012

I'm hoping someone will read this who was at the Mapco on Dave Ward Drive (gas station on the right, right before you get to the I40W on ramp). On September 19, 2012 at aprox 8am - 8:15am, there was a minor accident. I was behind a light colored truck. I drive a small silver car. I was behind him on the right side where you exit the property to turn out onto Dave Ward Drive. A semi truck / 18 wheeler was turning in. The guy driving the truck in front of me put his truck into reverse, I'm guessing he thought he was in the way of the 18 wheeler trying to turn in, and backed into my car, damaging the hood. The damage is putting me $1,000 out of pocket because of my deductible (acutal damage $1,437). I didn't have a second to spare as my son was ill in daycare and I had to get him otherwise I probably would have taken the time to notify the police, and now I wish I did. The driver of the truck is saying I rear ended him. I've contacted the Mapco owner and management who is speaking with employees who were on duty that morning to see if someone witnessed the accident who could give a statement to the insurance company. I'm seeking anyone who may have driven by at the time, maybe had been at that gas station and saw it happen. I'm absolutely disgusted with this man and his lies. He is the owner of a business here in Conway. If anyone, ANYONE, saw what really happened and can help me I would be more grateful than words can describe. Thank you and I know this is a long shot but it's still worth a shot to get this lying and irresponsible driver to pay for the damage HE CAUSED!!!! Oh and yes we did exchange insurance information. I went through my insurance company for this matter and my insurance company is seeking the money from his insurance company for the damages. His insurance is saying they are not responsible. If my insurance company can get a statement from a witness this is what we need!!!

Report

File a police report. Give them his information. If the police question him, he may be less inclined to lie about it. If he does lie about it to police, and then they can prove that he lied, he's in even more trouble.

Also, good on you for being proactive. You may ask the folks at Mapco, and maybe even across the street at that other gas station, about camera footage. Even if a camera could get a good shot of the semi truck, if there are identifying numbers on it, you should be able to contact the trucking company with the date and time and find out who the driver of the truck was. He would make a good witness if he's willing to get involved. He would probably remember it if he saw someone backing up for him and then back into another car.

So sad

I know hindsight is 20/20 and it is hard to be delayed when trying to get to your sick child but filing a report is so vital. I always stress to anyone who is the victim of a car wreck that they request a police report no matter how small the damage may be. You never know when you might actually need it.

I hope your kiddo is feeling better and that this irresponsible person decides to become an adult someday.

It happens

all the time on Dave Ward. Not just that type accident, ALL types. T-bone, rear ender, rollover, etc. Seems that people are so busy with their own lives these days that they can't drive without playing bumper cars. I work over there in the general area, and have seen literally hundreds of accidents in the last 20+ years. More since all of the signals were put up (especially at Acxiom). I remember a rear-end accident right in front of Axciom which caused an SUV to roll over. I saw the entire thing unfold right in front of my eyes. Was not a hard hit at all, but apparently it doesn't take much to roll a Toyota 4-runner SUV. No injuries that I am aware of.

And Buzz has it right. Private property accidents are not anything that police will deal with. Been there, done that. It's pretty much between your insurance company and the other driver's insurance company. If all else fails, you can always take it to the courts, that is, if your insurance company doesn't. I may be wrong and correct me if I am, but if it's under $5000 compensation, small claims can handle it. Did you take plenty of pictures?

A good example...I was hit from behind in a chain reaction accident on Dave Ward westbound at Donaghey. This has been probably 10 years ago. I was not injured. Vehicle behind me, that driver had a few cuts and bruises and was hauled off by MEMS. Just as I realized I had been hit, I was out of the car, taking pics of the entire ordeal, and the pics were given to the insurance company who took legal action against the faulted driver, who did not have insurance. I was out of pocket absolutely nothing, actually I made a little but it was more or less insignificant. The vehicle I was driving was a very rare vehicle, one that most of the repair parts were discontinued/NLA. Point being....if you don't take the time to do the legwork, chances are probably good that you'll get absolutely nothing.

Unfortunately, I don't think pictures would do much good in a scenario where one person says they were backed into and the other says they were rear-ended.

You're absolutely right about Dave Ward Drive being dangerous. I've seen more people run red lights on that road than any other place.

Is there a traffic light camera there? Perhaps you could get something on that.
